Inkkes respects the intellectual property rights of others and expects users of our Service to do the same. This Copyright & DMCA Policy explains how we handle claims of copyright infringement on the Inkkes platform.
Although Inkkes is based in Malaysia and primarily governed by the Copyright Act 1987 (Malaysia), we follow a notice-and-takedown procedure modelled on the U.S. Digital Millennium Copyright Act (DMCA). This approach is widely recognised by creators and rightsholders worldwide.
1. Our Policy
It is our policy to:
- Respond promptly to valid notices of alleged copyright infringement
- Remove or disable access to material that we reasonably believe infringes copyright
- Terminate, in appropriate circumstances, the accounts of users who are repeat infringers
2. Reporting Copyright Infringement (Notice of Claimed Infringement)
If you believe that content on Inkkes infringes your copyright, please send a written notice to our designated Copyright Agent containing all of the following information:
- A physical or electronic signature of the copyright owner or a person authorised to act on their behalf
- Identification of the copyrighted work claimed to have been infringed (or a representative list if multiple works are involved)
- Identification of the material that is claimed to be infringing, including information reasonably sufficient to allow us to locate the material on Inkkes (e.g. the URL of the comic or episode, series title, and username of the uploader)
- Your contact information (name, address, telephone number, and email address)
- A statement that you have a good-faith belief that the use of the material in the manner complained of is not authorised by the copyright owner, its agent, or the law
- A statement that the information in the notice is accurate, and under penalty of perjury, that you are the copyright owner or authorised to act on behalf of the owner
Please send the notice to:
Email: inkkessupport@gmail.com
Subject line: Copyright Infringement Notice – [Series/Comic Title]
We will review valid notices and take appropriate action, which may include removing or disabling access to the allegedly infringing material.
3. Counter-Notice Procedure
If your content was removed or disabled as a result of a copyright notice and you believe the removal was a mistake or misidentification, you may submit a Counter-Notice.
Your Counter-Notice must include:
- Your physical or electronic signature
- Identification of the material that has been removed or to which access has been disabled, and the location at which the material appeared before it was removed or disabled
- A statement under penalty of perjury that you have a good-faith belief that the material was removed or disabled as a result of mistake or misidentification
- Your name, address, telephone number, and email address
- A statement that you consent to the jurisdiction of the courts of Malaysia, and that you will accept service of process from the person who provided the original copyright notice (or their agent)
Send the Counter-Notice to the same email:
Email: inkkessupport@gmail.com
Subject line: Copyright Counter-Notice – [Series/Comic Title]
Upon receiving a valid Counter-Notice, we will forward it to the original complainant. If the complainant does not notify us within 10–14 business days that they have filed a court action seeking to keep the material down, we may restore the content at our discretion.
4. Repeat Infringers
Inkkes reserves the right to terminate user accounts that are determined to be repeat infringers of copyright, in appropriate circumstances and at our sole discretion.
5. Important Notes
- Submitting a false or bad-faith copyright notice or counter-notice may result in legal liability.
- This policy does not constitute legal advice. If you have questions about your rights, you should consult a lawyer.
- Inkkes is not required to actively monitor all content for infringement, but we will act on valid notices we receive.
- This policy is in addition to, and does not replace, our Terms of Service and Creator Terms.
